The perfect storm? — There is approx. $1.3 trillion dollars worth of commercial mortgages maturing between 2011 and 2015. In many cases, these “under-water” mortgages and the underlying collateralized property will be foreclosed.
Our services are designed to help the current property owner avert foreclosure, or in the unfortunate event of foreclosure, the special servicer appoints Madison & Hoyt, through the courts, to manage and dispose of the asset. Special knowledge and experience are required to navigate through these complex issues.

Court Appointed Receivership– As a custodian of the court and working for the interest of the financial institution (plaintiff) , we basically step in as financial managers, in collaboration with the attorneys, CPAs and bankers, and run the day to day operations and prepare for the winding up and eventual sale/liquidation of the real estate holdings.
Marshalling the Asset

- Secure all assets (bank accounts, accounting records, FF&E)
- Secure all documents pertaining to building, i.e., blueprints, easements, warranties and leases
- Inspect the property and identify potential fire, water, liability and theft hazards
- Notifications given to tenants, vendors, insurance company, utilities, security alarm company, tax assessor and other government agencies
